Apple faces defeat in German legal battle with Samsung

Dusseldorf - US computer giant Apple could be facing defeat in its legal battle in Germany over the design of Samsung's tablet computer, a judge indicated on Thursday.
After the court in Dusseldorf banned the sales of Samsung's Galaxy Tab 10.1 N in September, judge Johanna Brueckner-Hofmann said the Korean-based Samsung has changed the design of the tablet significantly from Apple's iPad tablet.
The somewhat wider frame and the large manufacturer's logo on the 10.1 N was 'something that immediately catches your eye,' Brueckner-Hofmann said.
This meant the Samsung device was no longer similar to the design of the iPad, the judge said.
But a lawyer for Apple hit back saying: 'Ultimately the overall design is still the same.'
The lawyer for Apple went on to say: 'If someone wants to offer tablet computers in the same market and price segment, the device must be sufficiently different.'
