Apple fails to stop German sales of new Samsung Galaxy

Dusseldorf - Apple failed Thursday to stop the sale of a new Samsung tablet specially made for the German market, after a court in Dusseldorf said shoppers were unlikely to confuse the redesigned Galaxy Tab 10.1 N with the iPad.
The worldwide Galaxy Tab 10.1 model was last year banned in Germany, with the court ruling that it unfairly copied Apple's popular tablet. Samsung responded by altering the design for the German market and adding the letter N to the name.
Judges on Thursday said that while there was still some resemblance to the iPad, it was not enough to confuse shoppers or damage US-based brand.
The devices made by Apple's South Korean rival run the Android operating system. Germany has been the focus of a worldwide legal battle between the two groups over claims that style rights and patents were breached.
