The court denied the petition in a four to one ruling. The trial, which has not begun, deals with the killing of three of Pinochet's critics.
The ruling means that the 90-year-old former Chilean leader will remain under house arrest. Pinochet has also been charged with other human rights abuses and tax evasion.
A medical examination had recently declared that the former dictator is fit to stand trial.
