So, this guy knew bin Laden and knew bin Laden was an un-convicted criminal. An un-convicted criminal is not a criminal at all because our law assumes people are innocent until convicted to the contrary. So, this guy was driving an innocent (in the eye of the law) guy around.
What if all taxi drivers assume everyone in New York is guilty of something. Does that make all taxi drivers guilty if they happen to get a fare that is an un-convicted criminal?
This sounds way to problematic to me. In the United States even un-convicted criminals are allowed to be driven around.
Was there evidence that Hamdan drove bin Laden to an event where known criminal activity was going to be committed? Like a getaway car for a bank robbery?
The lack of information is a tragedy and lends itself to question the trial and if justice has been done.

I think the sentence was correct in proportion to his deeds.His conditions of detentions however were not,neither was the very principle of him standing accused in front of a military US court that holds no jurisdiction .Many flaws in the system ,but not in the result .

If Hamdan committed a criminal act or was involved in one directly then that is one thing. But, if he drove around a suspected criminal while not doing criminal activity then that is another.

Well, you have a point there ... almost. There is also the issue of jurisdiction and other matters. But lets not split hairs. In the U.S. no one is above the law. It is just that certain laws do not apply to certain people. For example: The president can order the flesh burned off of little children (for example with napalm) whereas the ordinary U.S. citizen can not without a good chance of being convicted if it went to court.

I noticed that Hitler's driver was not prosecuted for anything. He probably didn't know anything about all the war crimes that the nazis were committing during WWII. This idea is very credible, since most good Germans didn't know anything either, and were totally unaware of the atrocities and war crimes that were occuring then right in their own backyards. These good Germans were not prosecuted, nor should they have felt guilty of anything except being patriotic, and loyal to their Aryan cause. Hitler, practically alone, but at times with a few top henchmen, committed all the countless acts of evil.
Hamdan, on the other hand, was alleged to be in the inner circle of the al qaeda, holding top level jobs like car driver. He was most definitely one of the 'worst of the worst'. It is certainly fair and reasonable to expect that his proposed punishment of 30 years in military prison would serve American justice very well. Most Americans have been led to believe that he should be executed for the outrageous war crime of driving his boss's vehicle, and trying to do his job. It is a total outrage to the American justice system that this military tribunal did not sentence this top terrorist to death, or at least 30 years in prison. Even though he supposedly did not commit any war crimes, he must be a war criminal. If they wanted to show some degree of mercy to this islamofascist enemy combatant/noncombatant animal then a 30 year sentence, instead of a death sentence will demonstrate just how magnanamous, and religiously grounded the Americans really are. But a mere 5 years is totally unacceptable.

I always knew that the so-called miltary tribunals would be a disaster for American justice, ever since they were approved by the libnazi- oriented supreme court. Our guys had a chance to just make these 'worst of the worst' enemy simply 'disappear' while they were resorting at gitmo. Instead they made most of them reluctantly return home after they were treated to their all expenses paid vacations where they lived in the equivalence of 5 star accomodations. After those ungrateful bums were kicked out, there were only a handfull left who required the heavy hand of justice. But, where death sentences were to be expected to be given to these war criminals, the libnazis again interferred and rigged the tribunals so justice was not served. 5 years only, for being a driver, is a disgrace, and sorry to say, the defeatocrats prevailed, perverting American justice once again.
I'm happy with all this. The best part: Johnny Haj can, at the end of his sentence, be held as P.O.W. indefinitely, as this war can go on forever....very hard to armistice with a terrorist enemy...ya knoow?
